Operators policy:

CONDITIONS OF CHARTER

General

Persons booking and or boarding any vessel operated by Adrenalin Snorkel & Dive, the Operator, do so

subject to the following conditions.

1. The passenger boards the vessel at his/ her own risk.
2. The Operator shall not be responsible to the passenger, or his/her Executors, Administrators or Dependents for any loss or damage to property in the possession or control of the passenger, or for any injury to or the death of the passenger, arising out of or incidentally to the passengers passage on the vessel, whether occasioned by the negligence, breach of duty, or other default of the operator or crew
3. The Operator shall, at the absolute discretion of the master, be entitled to:
   1. refuse to allow any passengers to board the vessel
   2. refuse to allow any passenger to leave the vessel for any purpose, whilst at sea;
   3. allow any passenger to leave the vessel upon such terms as the master thinks fit.
4. In the event that the charter is cancelled by the Operator, a full refund will be available.
5. In the event that the requested vessel becomes unavailable on the charter date, Adrenalin Snorkel & Dive will endeavour to provide a suitable alternative vessel. 
6. In the event that, no suitable alternative vessel is available on the charter date, a full refund will be

available.  

7. Under no circumstances shall Adrenalin Snorkel & Dive be liable for any loss of profit or damage howsoever suffered by the Charterer arising as a result of the cancellation of charter for any reason or the substitution of the vessel.
8. Should the Master determine it is safe to proceed with the charter, but the Charterer chooses to cancel, standard cancellation fees will apply. 

Diving Charters

1. Charters scheduled to the wreck of the Yongala are weather dependent. If the Master deems the weather conditions unsafe, the charter may proceed to the protection of the Great Barrier Reef.
2. Hire Equipment is available. Equipment must be returned in the same condition as hired out or a cleaning, repair and/or replacement fee will apply.
3. The Operator, through the Master of the vessel, shall be responsible for the safety of the vessel at all times and in that respect shall be entitled, at the discretion of the Master, to
   1. cancel any voyage;
   2. substitute any destinations for the named destinations.
   3. amend the schedule of the voyage
   4. postpone any voyage to a date in consultation with the Charterer;

DEPOSIT/PAYMENT 

1. Adrenalin Snorkel & Dive shall not be bound by the Charter’s booking until such times the Charter provides the following: 
   1. signed Charter Agreement 
   2. payment of 30% of the agreed charter amount at the time of booking. 
2. For charters of less than 24 hours, payment in full of the agreed charter amount no later than 14 days prior to the charter departure date. For charters longer than 24 hours, payment in full of the agreed charter amount no later than 30 days prior to the charter departure date.

RESCHEDULE / CANCELLATION BY CHARTERER

1. Cancellation of a charter booking is required in writing from the Charterer and may be emailed to operations@adrenalindive.com.au.
2. Where the Notice of Cancellation is received at least 30 days prior to the charter date, a cancellation fee of 10% of the agreed charter price will be payable to Adrenalin Snorkel & Dive by the Charterer. 
3. Where Notice of Cancellation is received less than 30 days and more than 7 days prior to the charter date, cancellation fee of 25% of the charter price be payable to Adrenalin Snorkel & Dive. 
4. Where Notice of Cancellation is received less than 7 days prior to the charter date, the full charter fee will be payable to Adrenalin Snorkel & Dive. 
5. Adrenalin Snorkel & Dive will refund any monies held in excess of the cancellation fee to the Charterer within seven (7) days of the date on which the notice of cancellation is received.
6. In the event that the Charterer wishes to vary the charter date, the Charterer must provide at least 30 days written notice to Adrenalin Snorkel & Dive. Where less than 30 days’ notice is given a reschedule fee of 25% of the charter price may apply. 
7. Rescheduled charters must be held within 60 days of the original booking, or standard cancellation fees will apply.
