Scuba Diving Restrictions
- Certain medical conditions and medications may preclude some people from scuba diving.
- Participation is subject to a medical questionnaire completed on board with the tour operator
- Minimum age for scuba diving is 12 years.
- Flying after scuba diving: a wait of 12 hours is recommended after one dive, 18 hour after 2 dives and at least 24 hours after multiple dives, before ascending to an altitude of 300 metres or greater.

Public Holiday Surcharge - 5% ($550) per public holiday on top of charter fee
When booking Havanna, guests agree to pay the applicable charges and to be bound by the following terms and conditions:
Booking & Payments
Deposit: 30% of the charter fee is required at the time of booking and must be made within 48 hours of securing dates or the charter dates will be forfeited. 30% of the charter fee is required for day and half day charters.
Balance of payment due in full 60 days prior to departure.
Cancellations (overnight):
20% non-refundable deposit paid at time of booking
45-60 days before departure = 50% cancellation fee (50% refunded)
31-44 days before departure = 75% cancellation fee (25% refunded)
0-30 days before departure = 100% cancellation fee (no refund)
If guests elect not to travel due to weather but the charter is still deemed operational, a 100% cancellation fee applies.
Cancellations (day + half day):
As above, however 30% non-refundable deposit paid at the time of booking.
Charter Adjustments
Changes to guest numbers are permitted up to 14 days prior to departure, subject to vessel capacity and requirements.
Maximum guest capacity: 14 for day charters / 9 for overnight charters
Weather & Itinerary
Return times may vary due to weather or unforeseen circumstances. No compensation will be offered for late returns.
The Master of the Yacht (Captain, hereafter referred to as MASTER) will determine the final destination/anchorage on the day of charter based on safety and weather. Requested locations cannot be guaranteed.
Outer reef charters operate only in winds up to 15 knots for guest comfort. Alternate locations will be offered if conditions are unsuitable.
In the event of extreme weather (e.g. named cyclone), Havanna will cancel the charter for guest safety. In such cases, an alternative
date will be offered or a full refund provided.
No compensation will be offered for missed activities, toys, or locations due to weather or operational limits.
Onboard Policies
Shoes are not permitted on board.
Smoking is allowed in designated outside areas only.
All guests must follow directions from the Master and crew at all times.
If safety instructions are not followed, or if the safety of guests, crew, or vessel is at risk, the Master may terminate the charter and return to port. In such cases, no refunds will be provided.
Conduct & Safety
Rowdy or unruly behaviour, excessive consumption of alcohol, consumption of illegal substances or disposal of rubbish over the side of the Yacht is not permitted and may result in early termination of the Charter, discharge of passengers at the nearest safe location or
summons of police, at the sole discretion of the Master or Havanna
Any costs associated with the early termination of the charter due to unacceptable behaviour will be borne by the yacht.
The guests will not be entitled to a refund for early termination of the Charter due to unacceptable behaviour.
Any fines imposed by the relevant authorities with respect to rubbish thrown over the side of the Yacht by a passenger, or any other claim or cost incurred due to the unacceptable behaviour of the passenger will be the responsibility of the yacht.
Guest Responsibilities
Guests must use the vessel and all equipment with reasonable care. Guests are responsible for the cost of:
a) Damage to the vessel, furnishings, or equipment caused by guests or their invitees.
b) Replacement of any non-repairable or lost recreational equipment.
c) Excessive cleaning due to misuse.
d) Any damage caused by negligence or failure to follow instructions.
Luggage
We encourage packing lightly to free space on the boat - ideally luggage kept to one small suitcase and one carry bag per person

Insurance & Liability
Havanna holds US$25 million public liability insurance
Personal health and travel insurance is strongly recommended.
The Master and crew will always act in the interest of safety, but Havanna accepts no liability for personal injury, property loss, or any unforeseen incident occurring during the charter.
To the extent permitted by law, Havanna shall under no circumstances be liable to the guests for any loss, damage, claim, injury or harm sustained or incurred by the guests or a passenger as a consequence of or resulting directly or indirectly from the charter
including as a result of any default, fault or negligence of Havanna, Master or any crew, employee, agent or contractor of Havanna, or for any indirect or consequential loss of any nature.
In any event, the liability of the Havanna its servants, agents and sub-contractors is limited in accordance with the Limitation Of
Liability For Maritime Claims Act 1989 (as amended, re-enacted or replaced).
Additional Charges
Any outstanding onboard expenses must be settled with the Master via cash or credit card prior to disembarkation.
Crew gratuity (guest’s discretion), Special request wine and liquors that are not normally part of guests beverage package, dockage at charterers request other than initial pick up and drop off, dinners ashore, shore side transfers and excursions, or shore lodging such
additional costs will be deducted from the guest’s credit card.
